We at Confidential Matchmakers ask you to please read carefully the Terms and Conditions as outlined below before becoming a member. If you do not accept these Terms and Conditions please do not register to become a member of Confidential Matchmakers.

In order to become a Member of Confidential Matchmakers you must be at least 18years of age, complete registration forms and click Yes to the Terms and Conditions.

When the conditions required for registration are met, each Member will have a log-in name/number and one or more passwords. These identifier(s) and password(s) are strictly private and confidential and must not be passed on or shared with any third parties.

If a Member disseminates or uses these elements in a manner deemed contrary to its original purpose, Confidential Matchmakers will terminate the Member's Account.

The Member shall be solely liable for the use of this log-in information by third parties or for the actions or statements made through the Member's account, whether these be fraudulent or not. The Member holds Confidential Matchmakers harmless against all claims of this kind. As Confidential Matchmakers does not have the obligation or the technical means to check the identity of every person registered to its site, Confidential Matchmakers will not be liable in the event of a Member's identity being used by a third party.  Confidential Matchmakers must be informed immediately if a member suspects, or has reason to believe a third party is using his or hers personal log-in information, or account.

Confidential Matchmakers reminds its Members that they are prohibited from disclosing information that allows them to be identified, such as last names, postal/email addresses or telephone numbers, to other Members  through the Services.

For security and quality purposes, Confidential Matchmakers reserves the right to deactivate the accounts of Members who have not used their member account for a period of 6 months or more.

Upon registration, the Member can take advantage of access to Services available with Confidential Matchmakers. Prices and terms of payment for Services can be found under the Service button. This can be accessed at any time via Confidential Matchmakers site.

Confidential Matchmakers require current information. You must provide curent, complete and accurate information for your billing account. You must promptly update all information to keep your billing account current, such as a change of address, credit card number or expiry date. You must notify Confidential Matchmakers promptly if your payment method is cancelled through loss or theft, or if you become aware of a potential breach of security, such as unauthorised disclosure or use of your username or password. You can inform us of changes via the website or through phoning our office. If you fail to provide Matchmakers Confidential of the foregoing information, you agree that Confidential Matchmakers may continue charging you for any use of services under your billing account unless you have terminated your subscription.

Confidential Matchmakers cannot be held liable for false declarations made by a Member. Therefore, it is imperative that Members take certain precautions when arranging to meet up with another Member. Confidential Matchmakers assumes no responsibility for meetings between Members when this occurs outside of their offices, online or during webcam interviews between Members as a consequence of the use of the Confidential Matchmaker site and Services. In addition, on a first date, without your translator/Buddy it is recommended that you tell someone close to you and choose a public place (coffee place, pub, restaurant etc.).
The Member has the following General Obligations:

• To act fairly in respect of Confidential Matchmakers and other Members.
• To respect the intellectual property rights relating to content supplied by Confidential Matchmakers and by other Members.
• To understand that he/she alone defines the boundaries of his/her privacy and that it is his/her responsibility only to communicate to Confidential Matchmakers and to other Members such personal information the dissemination of which he/she considers cannot cause him/her any harm.
• Not to use Confidential Matchmakers for professional or commercial purposes (canvassing, soliciting or prostitution) or for any non-private purposes;
• Not to post, disseminate, or broadcast in any form whatsoever inaccurate or false information or content.
• Not to make comments, propagate or disseminate in any form whatsoever content that contravenes the rights of others or that is defamatory, injurious, obscene, offensive, violent or inciting to violence, political, racist or xenophobic and, in general, any content that is contrary to the purpose of Confidential Matchmakers, current rules and laws in force or acceptable norms and standards. In particular, photographs, videos and any other information in terms of data or files supplied by a Member of Confidential Matchmakers must be decent and refer exclusively to the Member or to a third party from whom the Member has expressly obtained consent and are the sole responsibility of the Member concerned.
• Not to mention on the Confidential Matchmaker website any personal information provided by a  Member (such as an email address, postal address, or a telephone number) enabling a Member to contact another Member without using Confidential Matchmakers.
• Not to post, disseminate, or broadcast in any form whatsoever information or content that has the effect of diminishing, disorganizing or preventing normal usage of the Services, or of interrupting and/or slowing down normal circulation of communications between Members through the Services, such information comprising, for example, software, worms, viruses, software bombs, mass mailing, etc. Confidential Matchmakers reserves the right to delete messages sent in mass mailings by a Member in order to maintain the quality of use of the Services provided to its Members.
• Not to post, disseminate, or broadcast in any form whatsoever information or content that incorporates links to third-party websites that are illegal in character, contrary to what is generally acceptable and/or not in accordance with the principles of Confidential Matchmakers.
• To use his/her password and/or ID only for his/her purpose of authentification for the Services. In this regard, the Member must not, without limitation, communicate, disseminate, share or make accessible, in any way, his/her passwords and/or IDs to any third party.
• To use the Services in accordance with the purpose set out in these Terms of Use.

Failure to comply with Terms and Conditions as detailed constitute a serious breach by the Member of his/her obligations. Confidential Matchmakers shall, where the Member fails to comply , be entitled to terminate the contract and will definitively delete the account of the Member concerned.

The trademark logos, graphics, photographs, and texts featuring on the Confidential Matchmaking site are the intellectual property of Confidential Matchmakers  and may not be reproduced, used or represented without the express permission of Confidential Matchmakers, under threat of legal action.

The rights of use accorded by Confidential Matchmakers, to the Member are strictly limited to accessing, downloading, printing and reproduction on all media (hard disk, floppy disk, CD-ROM, etc.) and to use of these documents for private and personal purposes in the scope of and for the duration for of the Member's membership with Confidential Matchmakers. Any other use by the Member is prohibited without the authorisation of Confidential Matchmakers.

In particular, the Member is prohibited from modifying, copying, reproducing, disseminating, transmitting, exploiting for commercial gain and/or distributing in any form whatsoever the Confidential Matchmakers site pages or software codes for elements comprising the Confidential Matchmakers site.

The Member grants Confidential Matchmakers a license to use the intellectual property rights attached to the content provided by the Member for the purpose of broadcasting on the Confidential Matchmakers Site.

This license in particular incorporates the right Confidential Matchmakers to reproduce, represent, adapt, translate, scan, use for publicity purposes, commercial or non-commercial, sub-licence or assign the content concerning the Member (information, images, videos, descriptions, search criteria, etc.) on all or part of the Confidential Matchmakers Services (on the site, by email, by webcam) and/or in mailings sent by Confidential Matchmakers and, in a general manner, on all distribution media, in particular electronic (email, SMS, MMS, WAP, Internet, CD-Rom or DVD-Rom), or through audiovisual communications media (press, radio, analogue television, digital television, cable or satellite).

The Member expressly authorises Confidential Matchmakers to modify this content in order to conform to the look and feel of the Confidential Matchmakers Services and/or other communications media above, and/or to make this content compatible with its technical processes or appropriate media formats. These rights are awarded on a global basis for the legal duration of the rights awarded, as well as current and future international conventions including any extensions that might eventually be agreed to this duration. The Member is prohibited from copying, reproducing or otherwise using for any purpose the content relating to other Members, except for the explicit requirements for usage of the Services for the Member's own strictly personal and private purpose.

The information supplied by a Member of Confidential Matchmakers must be accurate and conform to reality. The consequences of disclosing information on the life of the Member or of other Members are the sole responsibility of the Member concerned. It is the Member who takes the initiative to divulge and disseminate via Confidential Matchmakers personal information, data, text, content and images. Consequently, he/she waives all recourse against Confidential Matchmakers, notably on the basis of any possible damage to the Member's right to his/her image, the Member's honor and reputation, or the Member's privacy, resulting from the dissemination or revelation of information concerning the Member under the conditions foreseen by this agreement,  since the Member has given his/her prior, free and express consent to such revelation through his/her registering with Confidential Matchmakers and in application of these Terms and Conditions.

Confidential Matchmakers cannot be held liable for (and the consequences of) the accuracy or inaccuracy of the information and content provided by other Members, site visitors and/or the Member himself/herself. Correspondingly, Confidential Matchmakers cannot be held responsible for content distributed by a Member that might contravene the rights of one or more other Members or third parties.

The quality demanded of Confidential Matchmakers by both its site and its Members necessitates compliance with certain ethical standards in Members' expression and behavior, respect of third parties' rights, and compliance with applicable laws and regulations. In the scope of this requirement for quality, individual responsibility and ethics, Confidential Matchmakers allows Members to notify Confidential Matchmakers, on the Confidential Matchmakers site, the data (photograph, text, video), behavior or words of a Member which seem to them to infringe applicable laws or regulations, the image or the purpose of the Confidential Matchmakers site, the rights of any third party, or general good standards. Consequently, Members acknowledge and accept that the data they provide, as well as their behavior and words on the Service, may be notified by other Members, moderated and/or monitored by Confidential Matchmakers, on the basis of objective assessment criteria. Where such notification or monitoring reveals a breach by a Member of any applicable laws or regulations or of his/her contractual obligations, the provisions of these Terms and Conditions, the termination of membership may be enforced.

The following is a partial list of the kind of Content that is illegal or prohibited on the Website. Confidential Matchmakers reserves the right to amend this list at any times and to investigate and take appropriate legal action in its sole discretion against anyone who violates this provision, including without limitation, removing the offending communication from the Service and terminating the membership of such violators. It includes Content that:

• is patently offensive to the online community, such as Content that promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
• constitutes a Portrait or photographs of any third person used without their permission.
  harasses or advocates harassment of another person;
• involves the transmission of "junk mail", "chain letters," or unsolicited mass mailing or "spamming";
  promotes information that you know is false, misleading or promotes illegal activities or promotes conduct, or that is abusive, threatening, obscene, defamatory or libelous;
• promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
• contains restricted or password only access pages, or hidden pages or images (those not linked to or from another accessible page);
  provides material that exploits people under the age of 18 in a sexual or violent manner, or solicits personal information from anyone under 18;
• provides instructional information about illegal activities such as making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses;
• solicits passwords or personal identifying information for commercial or unlawful purposes from other users; and
  engages in commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.

You must use the Service in a manner consistent with any and all applicable laws, regulations and codes of conduct.

You shall not engage in advertising to, or solicitation of, other members to buy or sell any products or services through the Service or to attend parties or other social functions or networking for commercial purposes. You may not transmit any chain letters or junk email to other members.

Although Confidential Matchmakers cannot monitor the conduct of its members off the Website, it is also a violation of these rules to use any information obtained from the Service in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any member without their prior explicit consent. In order to protect our members from such advertising or solicitation, Confidential Matchmakers reserves the right to restrict the number of emails which a member may send to other members in any 24-hour period to a number which Confidential Matchmakers deems appropriate in its reasonable discretion.
Prohibited Activities. Confidential Matchmakers reserves the right to investigate and terminate your membership if you have misused the Service, or behaved in a way which could be regarded as inappropriate or whose conduct is unlawful or illegal. The following is a partial list of the type of actions that you may not engage in with respect to the Service:

• You will not impersonate any person or entity.
• You will not "stalk" or otherwise harass any person.
• You will not express or imply that any statements you make are endorsed by Confidential Matchmakers without our specific prior written consent.
• You will not use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine", or in any way reproduce or circumvent the navigational structure or presentation of the Service or its contents.
• You will not post, distribute or reproduce in any way any copyrighted material, trademarks, or other intellectual property or proprietary information without obtaining the prior consent of the owner of such proprietary rights.
• You will not remove any copyright, trademark or other proprietary rights notices contained in the Service.
• You will not interfere with or disrupt the Services or the site or the servers or networks connected to the Services or the site.
• You will not post, email or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.
• You will not forge headers or otherwise manipulate identifiers in order to disguise the origin of any information transmitted through the Service.
• You will not "frame" or "mirror" any part of the Service or the Website, without Confidential Matchmakers prior written authorisation. You also shall not use meta tags or code or other devices containing any reference to Confidential Matchmakers or the Service or the site in order to direct any person to any other web site for any purpose.
• You will not transmit or post any material which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party.

Except and only to the extent permitted under applicable law, you will not modify, adapt, sublicense, translate, sell, reverse engineer, decipher, or otherwise disassemble any portion of the Service or the Website or any software used on or for the Service or cause others to do so.

In the case where the responsibility of Confidential Matchmakers is pursued due to a breach by a Member of his/her obligations as defined in the scope of the law or by these present Terms and Conditions, the Member undertakes to protect Confidential Matchmakers against all claims or damages against Confidential Matchmakers, including full indemnification for any costs that might be incurred including lawyers' fees and court costs.

Confidential Matchmakers can supply or third parties may include hypertext links to other websites other than the Confidential Matchmaker site and to Internet sources. As Confidential Matchmakers is unable to supervise these external sites and sources, it cannot be held responsible for the availability of these external sites and sources, and cannot be responsible for their content, advertising, products, Services or any other elements made available on or from any of these external sites or sources. Any difficulty relating to a hypertext link must be submitted to the administrator or webmaster of the site to which it pertains. It should, furthermore, be noted that the consultation and/or utilisation of these external sites and sources are governed by their own Terms and Conditions.

If during the scope of a search performed on the Confidential Matchmakers site where the result of this search would point the Member to access sites, pages or forums of which the content and/or purpose constitutes a violation of the law, the Member is required to cease consultation of the site concerned in order to avoid being held responsible for such violation.

Confidential Matchmakers can be held responsible by a Member only where certain and definitive proof is adduced before the courts demonstrating a wrongful act committed by Confidential Matchmakers having caused that Member damage.

In this regard, Confidential Matchmakers shall in no circumstances be liable for direct or indirect damage to the Member where the Member's behavior contributed to the occurrence of the damage he/she claims to have suffered. By way of illustration, Confidential Matchmakers shall not be liable for direct or indirect damage suffered by the Member in the event of non-performance or incorrect performance of these Terms and Conditions by the Member.

You may terminate your membership at any time, for any reason, effective upon receipt by us of your written or email notice of termination. You may contact us at our address listed below or you may email us here.

We may immediately terminate your membership and your access to the Service at any time because you have breached this Agreement and will send you notice of termination at the email address you provide in your application for membership or such other email address as you may later provide to us. If we terminate your membership of the Service because you have breached the Agreement, we will refund any pre-payments made by you less reasonable costs and losses we have incurred. We can terminate this Agreement at any time by giving you reasonable advance written notice.

A Member may at any time and without the need to provide any reason end his/her registration Confidential Matchmakers by requesting the closure of his/her account in the area of the Confidential Matchmakers site designated for such purposes. Such request shall be deemed effective from the first working day after receipt by Confidential matchmakers of the request for closure of the account concerned.

Without prejudice to the other provisions hereof, where the Member commits a serious breach, Confidential Matchmakers will terminate the Member's account without prior notification or warning. Such termination shall have the same effects as a termination by the Member.

Without prejudice to the other provisions hereof, where the Member commits a breach, Confidential Matchmakers will terminate the Member's account  7 days after having sent to the Member an email requesting unsuccessfully that he/she comply with these Terms and Conditions

Such termination shall take effect without prejudice to any damages that Confidential Matchmakers might claim from the Member or his/her beneficiaries and legal representatives, in compensation of the harm suffered as a result of such breaches.

The Member will be informed by email of the termination, or the confirmation of the termination, of his/her account. Data relating to the Member will be destroyed at his/her request or upon expiration of the legal time period following the termination of the Member's account.

These Terms and Conditions, and the pages on the Confidential Matchmakers site to which these terms refer, constitute a contract that governs the relationship between the Member and Confidential Matchmakers (.com). They cancel and replace any conditions that may have been agreed to in the past, even if not directly withdrawn or amended, and constitute the entirety of the rights and obligations of Confidential Matchmakers and of the Member.

If any of the provisions of these Terms and Conditions is declared void in application of a law, a regulation, or a final decision of a court having proper jurisdiction, all other provisions shall remain fully in effect. Furthermore, failure by a Party to take action in respect of the breach by the other Party of any provisions of these Terms and Conditions, shall not be interpreted as constituting a waiver by said first Party of the right to take action in future in respect of such a breach.

Confidential Matchmakers may modify these Terms and Conditions at any time. The Member will be informed of the nature of these modifications as soon as they are posted on the Confidential Matchmakers site.

Service Access. While Confidential Matchmakers endeavours to ensure that this Website is normally available 24 hours a day, we do not guarantee that it will be uninterrupted or error free. Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

Customer Service. Confidential matchmakers  provides assistance and guidance through its customer care representatives, translators/Buddies. When communicating with our  representatives, you may not be abusive, obscene, profane, offensive, sexist, threatening, harassing or racially offensive. If we feel that your behaviour towards any of our  employees is at any time threatening or offensive, we reserve the right to immediately terminate your membership and you will not be entitled to any refund.
